Two recent cases dealt with FBAR penalties.
In one case, the US District of Attorney for NY has filed a complaint asserting $2 million in penalties and in the other the District Court for Western District of Washington dismissed the government’s complaint for an FBAR penalty due to failure to state a claim, without prejudice to refile.
