As the elderly population, and the need for long-term care, continue to increase, experts in healthcare law and estate planning stress the need to promote family caregiving through legislation. A recent article on the law of succession proposes changing the Uniform Probate Code (UPC) to include a modified elective share for family members who provided long-term care to the decedent.
