Wills: How to Give One Child Less

TrackBacks (0) Comments (0)

The Wall Street Journal has published an article by Rachael Emma Silverman titled "Wills: How to Give One Child Less." Ms. Silverman's article discusses parent's decision to bequeath uneven distributions to their heirs and the steps parents can take to help protect their will against legal challenges.

The article provides that parents may protect their will from legal challenges by:

(1) proving capacity and writing extra letters of instruction;

(2) being open about the distributions while alive or by letter or video after death;

(3) adding a statement explaining any disparity;

(4) drafting  a series of estate-planning documents over a period of months or years; or

(5) adding a no-contest provision.
