Testation and Contract Freedom

Adam J. Hirsh, William & Catherine VanDercreek Professor, Florida State University College of Law) recently published an article entitled "Freedom of Testation/Freedom of Contract."  The article argues that lawmakers should recategorize inheritance law and contracts law as cognate bodies of doctrine within a larger genus of transfers law.  The Article also examines comparatively the justifications for freedom of contracts and freedom of testation.
