Tate: Immortal Fame: Publicity Rights, Taxation, and the Power of Testation

Joshua C. Tate, assistant professor at Southern Methodist University, Dedman School of Law, published an interesting article in the Georgia Law Journal titled "Immortal Fame: Publicity Rights, Taxation, and the Power of Testation" (available on SSRN). In the article, Tate examines the tax problems that would arise if states decide to enact statutes providing for publicity rights to pass automatically to specified statutory heirs rather than honoring testamentary intent.
