Matter of Atkins

The New York Law Journal has posted Matter of Atkins, which was decided on March 26, 2010. The court concluded that the evidence presented a prima facie case for removal. Affidavits and supporting documentation relied upon by the court included "(1) contractual transactions between Mrs. Atkins and respondents in their individual capacity and (2) the highly poisoned relationship between Mrs. Atkins and respondents as evinced by their respective submissions in this proceeding and in the Florida litigation."
