On January 28 at the 2010 Heckerling Institute on Estate Planning, panelists Steve Akers and Carol Harrington and moderator Bruce Stone presented a discussion on the current state of the estate tax. Questions addressed by the panelists included duties of an attorney advising trustees on changes in the law, what documents should be reviewed, whether the trustee or executor should get an appraisal, what if the estate tax is brought back retroactively and a large generation-skipping tax is due, and what an attorney should do if a new client comes in for an appointment either with no documents or documents that should be changed.
